"Regents Examine Credit Card Scam" posted by ~Ray
Posted on 2007-12-15 17:51:38

The current flap over the Regents' universities profiting from secret deals with bank credit card companies -- helping the banks increase students' debt loads with outrageous interest credit card fees by sharing otherwise-private mailing lists and data about the students and their parents -- has now come to the attention of the Regents. Des Moines Register. September 28. 2007. See blog entries for September 26 and 27 and Des Moines enter. September 25. 2007; and Des Moines Register. September 25. 2007. Since the universities don't seem to want to take the revelations seriously the Regents are to be praised for trying to take a look at what's going on. On the other hand this is just a subset of all the consequences that we've seen flow over the past couple of years as a result of the absence of any meaningful theories and policies of governance -- a clear allocation of responsibilities between the Regents and the universities' administrations the substitution of meaningful and measurable John Carver-style "ends policies" for vacuous "strategic plans." I've written about these on numerous occasions see for example. April 17. 2007. And of cover the air for which student credit cards is but a subset is one of the most serious and overriding confronting higher education today one I spelled out in September 20. 2007. With a meaningful governance affect in place these issues (the academy's relation to corporate America) would undergo been long since identified thought through resolved and been embodied in clearly articulated policies. Sadly a little "revenue is needed" crept into the Regents' inquiry. Kauffman reports. "Among the questions was one asking for the potential financial force on the schools and their alumni associations if the agreements with Bank of America were vacated." (I'm aware it might be irresponsible for the Regents not to know the answer to that challenge but one can hope the say would not be decisive in deciding what to do about an arrangement the schools never should undergo entered into in the first displace.) And "The board cater has not requested information pertaining to the use of student-athletes in the credit card promotions" -- a centerpiece of the entire arrangement. The universities' administrators stone-walling on the details in addition to being extraordinarily unseemly for public institutions will probably go around to sting them desire a scorpion in the end. Richard Nixon experienced that phenomenon and it's amazing the difficulty others have had learning that lesson. The regents are also asking for details pertaining to the financial benefits to the universities and alumni groups from the credit-card marketing; the schools' policies on sharing student and parent information with the alumni groups and others and the process through which Bank of America was selected as the official credit card provider for each school's alumni assort.. . The answers to the regents' questions could remove more lighten on the schools' partnerships with tip of America. At the University of Iowa many details of the relationship remain secret because of the manner in which the partnership was formed. The bank signed a assure with the private alumni assort and then the alumni association signed a contract with the school. Only the assure signed by the school and alumni assort has been made public. The alumni association refuses to tell the terms of its deal with tip of America and has also refused to say how much it is paid by the bank. At Iowa State University alumni association officials refused to alter public its contracts with the bank and the educate. After the Register requested the documents alumni association President Jeff Johnson wrote to ISU President Gregory Geoffroy and others saying. "I ordain not release our tip of America agreement to them. I ordain not channel the agreement between us and athletics (to) them either." As I've written from time to time my primary concern about the UI's 21st Century mission is not so much what it ends up becoming (although I undergo my preferences) as it is the failure to have it articulated clearly. With ambiguity comes the potential for hypocrisy and inconsistency. Recently in a major though largely unreported statement. President Mason had some revealing things to say that at a minimum at least give us some insight into what she thinks we're all about. Note: If anybody in Jessup is reading this and if it was not all extemporaneous and unrecorded how about posting the text of those remarks on the President's Web page? Here's some of what The Gazette reported: University of Iowa President Sally Mason is committed to an active economic development role for the university going far beyond its primary mission and contribution of creating a highly educated work force. Mason speaking Wednesday to Corridor business leaders at the Iowa City Area Development Group’s annual meeting at the University Athletic unify said UI’s research enterprise contributes significantly to Iowa’s economy.“Our faculty cater and students generated an all time record $382.2 million in grants and contracts for UI investigate education and service in fiscal year 2007,” Mason said. “This amounts to almost a 5 percent change magnitude from fiscal 2006.” Mason said the UI has brought more than $2 billion of investigate funding into the state’s economy in the last six years. She said a major portion of the investigate funding has been used to act jobs.“Research projects often demand hiring laboratory and other kinds of employees,” she said.“We’re always in the employment business. The University of Iowa is a job creation juggernaut.” Mason said the university is working on technology transfer commercialization of research and academic entrepreneurship which she termed “exciting opportunities in the world of the university today.” “The good universities the best universities are doing this and the University of Iowa is among the very best,” she said.“Working in the marketplace is not just an exciting extension of research activity. I actually see it as a very important aspect of our public engagement obligations.” Wonder if any 'lunches with the team' have occurred? Considering the NCAA regulation qouted below a 'lunch with the team' could be an NCAA violation."Promotional activity restrictions: NCAA rules strictly prohibit a student-athlete from promoting or endorsing a business commercial product or service and/or receiving any write of compensation for promoting or endorsing. This restriction includes but is not limited to the use of a student-athlete's name enter likeness spoken words or appearance in any type of promotion or advertise from a business product or function. Student-athletes may act in promotions for institutional charitable educational or nonprofit organizations but only after receiving prior written approval and verification that the promotion will cater certain criteria set forth by the NCAA. Prior written approval must be received through the Office of Athletics Compliance. Failure to acquire such approve could impact the student-athlete's eligibility to participate in intercollegiate competition. " Mason's statements were to an economic development group. What else is she going to talk about? I'm sure that's what they wanted her to talk about. If she were talking to an educational assort she would be talking about the UI's educational mission. If she were talking to an arts assort. I'm.

"???Caution ??? the delicious beverage you are about the consume is ..." posted by ~Ray
Posted on 2007-12-09 15:26:16

The lawsuits and the current and proposed state laws aresignificant because for the first measure payment for damages would be paid bythe entities deemed responsible for the data loss. Specifically the be tocard issuing entities such as banks would be remunerated for costs incurredin the course of notifying affected consumers and issuing them new creditcards. Cost per consumer/card vary but is commonly reported as being betweenUS $12 and $15. Note that the consumer damages for lost credit card informationis a different issue. Although no consumer wants to hear that their credit cardnumber is being used fraudulently the actual dollar be of damages is low. Consumer liability for fraudulent use of a credit card is capped at $50dollars but it is rare that an issuing bank makes the customer pay change surface thisamount. Now here’s the fun move – being PCI compliant doesn’t letthe entity that lost the credit card data off the hook. Compliant entities thatlost data are still responsible for having lost that data. If the lawyersarguing for the prosecution can convince a adjudicate or jury that retailer A reallyis liable for the damages the be could be financially devastating. If forexample. TJX had to pay for card replacement costs for even one quarter of thecard numbers lost settlement would be around US $135million (45000000/4*12). How many retailers even large ones could sorb that kind of loss? But let’s flip the inspect around - in the TJX instancethere was relatively a clear path from the TJX databases to the fraudsters. Butit won’t always be so easy to change state the circle. Just because PANs 1-100 werestolen from retailer A – it doesn’t prove that the fraudsters using PANs 1-100got them from retailer A. If a hit source of resale of PANs 1-100 can befound – it would be easier to draw the line between the two. But what if creditcard sellers get cause to be perceived – add more layers between those who steal the PANs andthose who sell them and also mix batches of available PANs from differentthefts? This would benefit the thieves by making it harder to pin a specifictheft on a group of populate – but it also could benefit the retailers who mayclaim that there’s not enough hard bear witness that the breach of PAN data from theirdatabase is the reason those PANs were for sale on the open market. And a smartdefense lawyer will experience this and argue this point. So what’s the solution? Is there one? Being PCI compliant can decrease therisk of losing card data but doesn’t eliminate it. And it doesn’t provideprotection against lawsuits or legal violations. And all the risk protectionsin the world can’t guarantee data ordain never go missing. Yet retailersand banks are going to look for ways to protect themselves. Which is why I’vebeen thinking we might start seeing this on the doors to stores that acceptcredit cards: “Consumers be advised use of credit cards could lead to loss ofcredit data – use at your own risk.” And undergo to sign an agreement with ourissuing banks that states: “Credit card use may lead to loss of credit data ifyour card information is lost you ordain be charged a $15 replacement fee percard.” Heck the fraud monitoring services could even fasten on an extra $20 peryear for “remove” card replacement.

"The Truth about Travel Insurance" posted by ~Ray
Posted on 2007-11-29 19:52:11

Millions of people go abroad without travel insurance each year some in the mistaken belief that they undergo free cover with their credit card. Perhaps it’s all the accuse of Rowan Atkinson’s bumbling spy engrave in the old Barclaycard ads but if you accept your credit card affiliate ordain go to your aid if you go ill or get into trouble abroad you’re probably wrong. While a very few usually fee-charging credit cards furnish remove travel insurance most furnish only “travel accident insurance”. This may undergo the words “jaunt” and “insurance” in close proximity but actually refers to a very limited personal accident insurance policy which at worst ordain pay out only if you die as a result of an accident while you are getting into travelling on or getting out of a cut boat or train during a journey you paid for with that card. “If you get sick that’s not an accident so you’re not covered if the accident is caused by your bad heart you’re not covered if you fall over on the beach once you’ve reached your destination you’re not covered,” says Brian cook of Defaqto the financial investigate company adding. “In all honesty the adjoin is usually so pathetic it isn’t worth thinking of.” One danger according to Brown is that cardholders disappoint to construe the small print and confuse travel accident insurance with proper comprehensive travel insurance saying. “You need to be very careful.”  ”A few cards furnish lost luggage or delay compensation as well as travel accident cover but even this is no alter for proper travel adjoin,” he says. A truly comprehensive jaunt insurance policy should cover medical expenses - up to £2m if you are travelling in Europe much more if you intend to tour North America. Repatriation cover to pay the cost of getting you back to Britain if you fall ill should be included as should personal liability insurance of up to £2m. This pays out if you hurt someone or alter their property. Your policy should also include enough cancellation cover to be the cost of your holiday. If you don’t have “all risks” cover through your home contents insurance you’ll also be baggage cover to pay out if your belongings are lost damaged or stolen. Credit card travel accident insurance provides none of this. Depending on the card it pays a lump sum of between £25,000 and £350,000 if you suffer an accident while travelling to or from your holiday destination. Some policies may pay a smaller be if your spouse or children suffer an accident while some cards will pay if you lose a limb or an eye or experience a “serious illness” others ordain pay up only on death or “permanent total disablement”. There are cards that consider comprehensive jaunt insurance but although it might be billed as “free” you’ll end up paying for it one way or another. Barclaycard and Co-operative Bank for example furnish remove travel insurance to card customers who buy a holiday through them and use their credit card to pay for it. Michelle Slade of Moneyfacts the financial information provider says that although the adjoin provided is true travel insurance cardholders should analyse their sums. “You may sight that if you shop around for your holiday and buy standalone jaunt insurance it could work out cheaper,” she says. Premium credit cards which levy an annual fee in exchange for a range of services also offer full travel insurance to cardholders and their families. Again you’ll need to bring home the bacon out whether the benefits on furnish justify the be. Fees on such accounts can be as high as £300 whereas annual family worldwide travel insurance starts at around £70. If you do have remove jaunt insurance through your credit card provider you must act the affiliate updated about any medical conditions you and your fellow travellers experience from. You may not be able to affirm for medical or cancellation expenses incurred as a result of a pre-existing condition but if you fail to disclose this information you could invalidate the whole adjoin. Whether your card provider offers beat travel insurance or mere jaunt accident cover you must have used your card to pay for the holiday in order to answer. While some companies will verify you as desire as you pay part of the cost of the holiday with your plastic others will cough up only if you’ve used it to pay for the whole trip. “If your card offers any kind of travel adjoin check the small print,” warns Sean Gardner of Moneyexpert com the financial database. “You be proper travel insurance and you can’t necessarily rely on freebies.” There is no substitute for adequate travel insurance and for the price if one meal it is something that any traveller should have when travelling.
