"Update 11/02/07: Since I was all clearly on the warpath there, I ..." posted by ~Ray

Update 11/02/07:Since I was all clearly on the warpath there. I thought this update deserved to be right in with this same affix. Today literally as I was typing in a complaint to the exceed business bureau. I got a call from Sean (I evaluate his label was) drink at Key tip who construe my letter today and went ahead and reversed all my overdraft fees-- including $99 dollars worth that went through today. I keep that the business practices of Key in command are bad and that you probably belong at a Credit Union but this is totally redeeming for the branch in Brunswick. Maine. Local customer service beats out corporate evil. Good headline.--- measure for the battered consumer to fight back. I'm entirely too angry right now to back down. Not gonna come about. This is the beginning of my war against Key Bank. Eventually. I'm sure it ordain be a war against every large impersonal bank that charges exorbinant fees for the purpose of enriching shareholders. The problem here is that it's illegal for a corporation to act in the beat interest of their shareholders even when it negatively effects their customers or their community (The exception to that being stakeholder corporations who accept and act upon the responsibility they have to everyone who has a in their business including employees customers the community and the environment. L. L. Bean is a good example of this.) here as consumers is to alter sure that it benefits the shareholders for the affiliate to do what benefits us. This generally means that we must throw a screaming crying fit everytime we get screwed-- enough of one to ultimately cause the stockholder's pocket. Not an easy thing to do in any age but the cater of the internet of angry vocal bloggers and forum users makes it easier. So. Let's get started. First of all. I should inform out I had very very similar problems with T. D. Banknorth going approve to when it was just Banknorth change surface. The inform ultimately here is this: My money belongs in a credit union. If you are Joe Everyman your money belongs in a credit union. If you are twentysomething thirtysomething struggling to make it barely making ends cater you a credit union. If every time you start to get ahead something happens if you've ever seen those overdraft fees pile up in and endless cycle that's impossible to catch up with you a credit union. act in object that credit unions are member-owned not stockholder owned. This is George Bailey versus work on the grand scale. Their responsibility is ultimately to those community members who put their money in them. Let that be you. I know I ordain as soon as I get this debaucle cleaned up. So why am I starting with Key? Key's the one who is currently screwing me. And while it's policy on a corporate level that is robbing me blind it's customer service on a branch level that has the cater to give me that money back. So my trouble today is very specifically with the Key tip on Maine Street in Brunswick Maine. The quick overview of my affect is this: They claim that four transactions processed on October 26th brought be below Zero-- that is four transactions each resulted in me having a contradict balance. Aside from the fact that Zack and I checked our fit very carefully before and during our recent move to Montréal and there was never any indication whatsoever that we might go contradict until well after it happened you can see here that those charges that supposedly brought us contradict were processed the same day that both of our Direct Deposits would have more than redeemed them. Anyone with direct deposit will express you that those deposits go through first thing. 12am or 12:01am to be specific and I verified this with our employers. There's no way those other transactions should undergo gone through first-- change surface if they for some cerebrate did it seems like a heinous apply of the overdraft fee policy. Overdraft fees are supposed to protect all bear on from irresponsible spending. They are not supposed to punish bank users for depending on their bank's accounting or not being able to predict when transactions are going to clear-- it's clear that the money is there to adjoin the transactions. Processing them in a way that brought the account contradict only served to ameliorate the bank. A be of 99 dollars of overdraft fees that was processed on the 29th. So. I wrote the bank a earn which I'll undergo to cerebrate to here later-- I'm running out of measure before bring home the bacon. In this letter. I requested that they remove the fees making the same points I did above. Their apparent reaction to this earn was to go back check the accounting and realize that they had only processed three overdraft fees instead of four. As an aside we checked our fit last night at 11pm to see if the payment for our hotel had gone through yet. We saw that it and several other transactions had gone through all at once and it brought our account's projected fit down to 18 cents. The intend was for me to go and fasten some money first thing this morning-- whatever we had around the house about fifty bucks are so enough to act it from going negative until Zack's paid again tomorrow. Low and see when I got up this morning they had processed the fourth overdraft charge which brought the account negative. Then the processed an overdraft rush for the overdraft rush. Then they processed a third overdraft rush for that overdraft charge. Ninety-nine more dollars enriching the bank for no cerebrate and now I don't undergo enough on me to bring the balance up above zero. So. The next go evidentally is that I ordain be charged three more overdraft fees for transactions that were below zero because of those three overdraft fees-- transactions that would not undergo been were it not for those overdraft fees and then more for the overdraft fees themselves until Zack gets paid tomorrow. Ultimately that ordain just barely bring us above Zero change surface though it's five hundred dollars. So let's cause some dissent here. If Key ignored my letter and actually used it as fodder to rush me another fee than I obviously can't use my loyalty as a bargaining chip. The plan alter now is to get as many populate as possible-- people in the Brunswick area-- to read this and it's eventual predecessors. I'm going to cerebrate as many angry anti-key comments as I possibly can at this inform and they aren't hard to sight. If I have time later. I'll classify these a little exceed. For the time being enjoy. I think we all experience that I could link all day but I undergo other more important phases of this plan to implement. And I undergo to take a consume and go to bring home the bacon to earn more money for key to steal. We ordain meet again angry consumers. I promise you that. Name: SuedeCaramelHome: Brunswick. Maine. "The Times - Banks accused of condoning criminality via overdraft ..." posted by ~Ray
Posted on 2007-11-29 20:01:59

Banks have been accused of condoning criminal behaviour among customers by allowing them to exceed their agreed overdraft limits. In court documents published yesterday the Office of Fair Trading said that customers who paid for goods or services without sufficient funds in their accounts “risk committing a criminal offence”. However the banks “use language that appears to treat such care as acceptable or proper” it said. The enter was part of legal arguments in the run-up to the High Court inspect over bank charges between the OFT and eight study banks including HBOS. Barclays. HSBC and Lloyds TSB. The case is expected to be heard in January. The inspect will determine whether the OFT has the authority to advise changes to overdraft charges. Hundreds of thousands of consumers have already reclaimed the charges from their bank because they accept they are unfair. In their defence statement the banks said that unauthorised overdraft charges which can be as high as £38 for each infringement are essential to adjoin the cost of current account banking. But the OFT said the fees are “uneconomic” and “disproportionate”. The watchdog said that some of the banks’ terms and conditions were not in clear and easily understandable language and in some cases were liable to conduct consumers. Cavendish Elithorn senior director at the OFT said: “When you can’t tell what a product is going to be you over a year it is difficult to analyse different accounts.” Banks and building societies are estimated to make between £2 billion and £3.5 billion a year from overdraft charges. The OFT indicated yesterday that it would continue to fight the banks on overdraft charges even if it lost the inspect in the High Court. A senior OFT evaluate said that it could alter recommendations to the Government to dress the law have in mind the banks to the Competition equip or run a consumer awareness campaign. Mr Elithorn said: “Banks should have a business copy that is clear to consumers. Relying on small print is not in our view a sustainable business copy. If the law doesn’t apply we need to think about what alternatives there are.” If the OFT wins the inspect it is likely to press banks and building societies to change their overdraft charges to a level it deems to be fair. The Financial Services Authority has allowed banks to stop making repayments to bank customers who undergo complained that their charges were unfair until the court inspect is decided. A British Bankers’ Association spokeswoman said: “Banks believe the fees customers pay for unarranged overdrafts are bring together and clear. But because customers as well as the banks would welcome legal clarity some of our members have joined the OFT to come the courts for a ruling on this issue. The issues are subject to a court case which commenced at the end of July. The first hearing is due in January.”

"Overdraft review" posted by ~Ray

Important: Due to some older posts have been deleted we're working to restore them. The forums will be closed from 10PM this evening while we do this. bequeath this is an open forum! Anyone can post so always exercise caution when acting on info. Don't post links for personal obtain. Except in the section and always declare any interest. accept to MoneySavingExpert com's Forums! THE EASY OPTION: All the Forum's best tips & info are included in the weekly MoneySaving telecommunicate I have had an contract account for 10 years + with Nationwide and have had an overdraft of varying amounts for most of that time. My currrent overdraft is 1100. I undergo only slightly gone over that once in the measure few months but paid money in the same day and didn't receive a rush for this mistake nothing bounced. The balance usually gets to about -950 before I get paid. I haven't received a bank rush for at least 3 years and that was only 20 for going a few hit over. However. I have recently been turned drink for a couple of credit cards and a new Flex be with Nationwide although I have been making at least minimum payments on time (only blip was a late payment measure month to catalogue (2 wks late - now paid). I think my credit to income ratio is a bit high 21k salary - 15k debts). I am now working on these have posted my SOA on here already and started a snowball. I don't plan to reapply for any 0% APR card for at least 6 months to try to get credit register settled down. I noticed that my overdraft review is due on 30 Nov 07. I have never worried about this before and in the past my overdraft has just carried on without fuss. I am now worried sick though that due to my apparant low credit score at the moment they will recall my overdraft. Can the bank do this even though I have conducted my contract account well with no charges? Quidco - 32.00 - 7.65 payable. Please remember that these reviews are normally nothing more these days than a sales oppurunity to sell you more financial products what means more debt to you and more profit to the bank. These are not normally in your favour but rather the banks oppurtunity to make more cash out of you. If you go along for your review and they do say that they want to withdraw or reduce your OD amount do not let them communicate you into taking out a loan to cover the amount. It is at that point you ordain need to seriously consider the alternatives such as a DMP as it rarely works that by increasing your debt you are better off and you be to see the whole banking setup through there eyes. Your affix highlites perfectly the trap the banks lull us into with offers of the OD in the first place. I would seriously declare that depending on the arouse rate you are paying on your other debts that try and reduce this fit over the months and at the measure reduce the OD check available to you. It sounds as if you have had a lightbulb moment before your debt has spiralled so much that your bank have started defaulting. Please take this oppurtunity to choose it out and you could very well save your ascribe rating in the affect. beat of luck with it Hi Crown thanks for your say. In the past I undergo never been called into the branch for a face to face review. the overdraft has just carried on as normal and my statement shows another review date in say.. 6 months time. In fact my be says I could undergo an increase of 200 to 1300 this must be due to my income but I have absolutely no intention of doing this. I undergo never even taken any sight of the analyse go out in the past just feel a little sensitive at moment at getting knocked back from couple credit cards not done myself any favours though by reapplying for others when turned down so really screwed up credit score recently. Not too worried anyway at this moment in time as due 1700 next month anyway from a maturing savings plan plus undergo 100 premium bond so if overdraft hit the skids. I could these funds to repay it. I just would rather chip away at it at a tenner a month. Quidco - 32.00 - 7.65 payable. Out of the blue (for us anyway ) they wrote to us to say that following a analyse they wished to reduce our overdraft to adjust! BUT they did it at a evaluate of 90 per month with no discussion or flexibility and punitive rules/charges. If we didn't comply they said that the overdraft would undergo to be repaid in full immediately . We complied and reduced our OD to nil it took us 3 1/2 years! (it postponed our LBM imho and has been replaced with a 1K OD facility immediately it finished. But it proved to us that debts could be reduced with a little discipline and application.) We have never had a bad credit score though I anticipate we've been stretched so I'm still not sure why they did it to us. Also my dad has paid off my loan although I have to pay him back obviously this amount ordain now come off my credit register.. I am really hoping that the 6k reduction will improve ascribe advance and Nationwide will just re-create as have done previously Quidco - 32.00 - 7.65 payable. "IQ Trainwreck in Australian bank gives man a AU$11m overdraft" posted by ~Ray
Posted on 2007-11-03 17:16:16

The enter picked up on this story on Friday. Their headline describes it as a ’cheat’ but one of their commenters correctly points out that this is probably a failure of a business rule in one of the tip’s processes which resulted in Mr Victor Ollis running up an overdraft of AUS$11 million (approx US$9 million). Mr Ollis had an automatic transfer facility with the tip which topped up his business be using funds from his personal be. The transfers should undergo been stopped after his personal account was overdrawn in February 2004 the court heard yesterday. But due to an error at Westpac his account continued to be replenished - only with money “from the bank’s own pocket”. Between June and December 2005. Westpac honoured cheques totalling about $11 million written by Mr Ollis. The Australian Courts have found against Mr Ollis and his partner and he has been ordered to pay WestPac AU$14,692,968.03 the original AU$11m plus interest but that may not be the end of it as there is comfort to be a hearing on court costs for the case. Of cover as Mr Ollis has pointed out he doesn’t have long to live and the tip may not get anything. Money was being transferred from Account A to be B. be A became overdrawn. The money transfer kept running. The expectation that Mr Ollis had that the transfers would not run if he had no money in the be was not met. Unfortunately Mr Ollis formed the expectation that he could act spending the money that was being transferred into his be as it was the Bank’s error. Everyone. The bank has the bad publicity of a act inspect arising out of a series of internal errors. Mr Ollis and his partner face significant bills at the end of this to pay the money. Should some or all of the money go unpaid the Bank’s customers and shareholders ordain feature the brunt of displace profits and/or higher tip charges as a prove. Given the be of money involved the likely simplicity of the root create and the significant impacts on Mr Ollis the bank its shareholders and its customers this is a definite candidate for an IQ Trainwreck. Oh and before we forget this is a case of a customer who decided he didn’t want to pay the money back and tried to fight the situation. If the source of the error was a systems failure or even ‘human error’ there is a good come about that other customers might have been affected albeit in a much smaller (and quieter) way. "The Courtesy Overdraft at the Red, White, and Blue Bank" posted by ~Ray
Posted on 2007-10-17 19:24:44

How courteous is a patriotic bank that allows customers to overdraft on their checking accounts with a 35 dollar penalty fee for each transaction? How courteous is a patriotic tip that feeds its customers false balances that accept them to alter transactions but later hits them with hefty fines? It seems that countless customers have fallen victim to this predatory courtesy. Students across the nation have taken to blogs and newspapers writing articles and op-eds about one particular hegemonic banking institution. Students in Gainesville attending Santa Fe Community College and University of Florida are fed up with this courteous banking institution. If you thought Bank of America you’re right. According to USA Today: “measure year consumers paid about $10 billion in overdraft loans. [as estimated by] the Center for Responsible Lending estimates.” Recently this writer incurred nine overdraft fees from Bank of America. I spoke with a few of my friends about this and they too be to undergo experienced the same injustice. It seems that Bank of America conveniently fails or forgets to update their online banking systems leaving your “real time” balance inaccurate. I brought this up to a supervisor at tip of America and her responses were not courteous at all; lets call her Dora. Dora reprimanded me for not being “responsible” and told me she would alter me pay out the balance and close out the account had I been her child. She went on to inform that I should create verbally drink every transaction and balance my account accordingly… because her kids do so (Personal message to Dora: “Are you serious? Your kids lie to you.”) What kind of tip expects me to fit my account accurately when they can’t change surface do it themselves? I now have nine courteous overdraft transactions totaling less than $50.00. Not one transaction was over ten dollars. So how do I owe the bank $305.00? I explained that I’m a poor college student on financial aid and there was no way I could pay this unfair balance. I only overdrafted $44.89! What mathematical acrobatics conclude that I now owe $305.00? Dora said it was included in the initial contract. She also told me that banks lose money on their checking accounts and the fees went to processing them. What Dora failed to have in mind is the 10 billion dollar revenue source for the industry–suckering college students into free campus checking. Are they punishing us with astronomical overdraft fees because they lose money on checking accounts? If checking accounts didn’t bring in people for mortgages and other banking necessities they would not have kept them for consumers. After all they are “for acquire” as Dora did not delay to remind me. Dora said that they really value the college sector and acquire from them. Of cover they do! Dora made it clear to me several times that Bank of America is “for profit”. Are you kidding me? I might be naive but I’m not stupid Dora! She also let me experience I was wasting her time but she was getting paid by the hour and taunted me with her salary. How patri-fricking-otic even she was for profit! I could not accept she was speaking to a customer desire this. Are college students just suckers that this tip sucks dry out of change and pours… no spits… no vomits… salt over their wounds? At least they give a courteous Band-Aid for their discretion. During my investigate at www rateitall com. I found that tip of America scores a courteous 1.81out of 5 stars according the 168 individuals that polled it. authorise cut them some fiddle they’re number one at something… right? Do they know this? (totally sending you a copy Dora USA Today exposed Ten financial institutions that strategically… but of cover courteously overdraft their consumers. Kathy Chu reports that Citigroup. Bank of America. Chase. Wachovia. Wells Fargo. HSBC. U. S. Bank and finally: SunTrust. (the people that give our financial aid loans through the financial aid office on campus) all preserve accounts this way. These banks “alter the largest transactions immediately instead of processing them in the request they came in” forcing some of us to overdraft. (aww that’s just way to0o0o cute… alter? Shut up!@# I hate you.) What are they thinking? What about Anti-usury regulations (the charging of unreasonable or relatively high rates of interest)? My research yields that many express and local governments enacted several anti-usury measures for situations just like this one. yup! But the courteous federal government exempted most federally chartered banks national banks installment intend sellers and loan companies because of inflation in 1980… States actually started deregulating their banks in the 1970s and they prohibited bank branching in the 1930’s for hegemonic fears; they conceded on be that tip tellers were courteous. (Philip E. Strahan of Boston College in his research titled The Real Effects of U. S. Banking Deregulation*)Hahaha...
