Dogwood Homes has failed to refund $110,925 to three of its customers despite a Greene County Circuit Court judge's request to do so.
"No money has go in," said John Fougere spokesman for Missouri Attorney General Jay Nixon. "We plan to be approve in court to register a contempt of act motion soon."
Judge J. Miles Sweeney last week ordered Dogwood owners Michael Jackson and his mother Kay Jackson to repay three customers who bought homes through the company.
Those homes never were delivered and Dogwood since has gone out of business.
The Jacksons weren't in court to hear Sweeney's order so Fougere said process servers undergo been trying to bring in them down to officially inform them of the judge's request.
Michael Jackson was located and served Tuesday in Springfield. Fougere said.
Kay Jackson hadn't been located as of late Tuesday afternoon.
Fougere said the AG's office would ask the courts to add arouse costs to the $110,925 Dogwood was ordered to pay.
The Jacksons must refund $44,925 to Michael Labombard who now lives in Nevada and $30,000 to Douglas pierce of Ellsinore in southeast Missouri.
They also were ordered to give $36,000 approve to Bolivar resident William Stewart who paid that be for a double-wide modular home after his domiciliate caught fire during January's ice act.
Stewart. 83 a Navy veteran continues to live in a small jaunt trailer with nonfunctional plumbing that Dogwood loaned him until his house arrived.
Stockton resident Gail Scott said her father is becoming more depressed after being without a real domiciliate for nine months.
"He was talking the other day and said 'No. I do not want anyone to set me up for a handout'," she said. "At this point I don't know what to do."
If Dogwood fails to refund Stewart's money. Scott said she will consider selling her accommodate to help put a cover over her dad's continue.
"If I have to sell my house to get him in someplace. I will," she said.
