The on Thursday examined how the Employee Retirement Income Security Act --a federal law enacted in 1974 that exempts employer-sponsored pensionplans as well as health insurance and other benefits provided byemployers from state regulation -- could "invalidate many of thebudding efforts by states and cities to expand access to health care." Courtsin recent months have used ERISA to strike down laws in Maryland andSuffolk County. N. Y. that would have required employers to offerhealth insurance to employees or pay into a government fund tosubsidize coverage. A court in the next few weeks will consider thevalidity of a similar law in San Francisco. A similar law recentlyenacted in Massachusetts and a proposal under consideration inCalifornia "have been crafted with an eye to previous ERISA rulings, and other states are watching to see if the innovations will hit upon alegally acceptable formula -- or hit another brick protect in court,"according to the Joel Miller of the ,said. "Many states are watching.. to see how this is panning out,"adding. "What a lot of.. people who follow this hope for is that thestates will try to thread this needle." Richard Cauchi a health program director for the ,said. "Massachusetts gave hope in the sense of not just ERISA but theability to have bipartisan consensus," adding. "The insurers employersand the providers all were saying positive things." Miller said. "Evenin Massachusetts the ERISA preemption comfort hangs over the head of thepolicymakers trying to hammer out details of the plan." The Californiaproposal also could face a lawsuit related to ERISA. in the event that the "California plans ultimately are rejected by thecourts pressure could build on Congress to explain the law or issuewaivers to states trying to expand health coverage but experts "sayany changes to ERISA are unlikely." The Capitol. The seat of state government. Where influential politicians fashion laws and crafty lobbyists peddle affect. Where hopeful citizens try to get their voices heard. Get a be behind the scenes at New York politics and statewide campaigns here. New Yorkers are having fewer heart attacks and a credits the controversial 2003 state law banning smoking in the workplace. The study done by the state Health Dept and published today in the American Journal of Public Health open that there were 3,813 fewer hospital admissions for heart attacks in 2004 than would undergo been expected if the ban wasn’t in place. It represents a change state of 8 percent and a health care savings of at least $56 million according to the state. This is an uncontrolled study; what was their control assort? For example in that same year. 2003-2004. South Carolina experienced a %12.5 reduction in heart attack admissions without a smoking ban. Nebraska also enjoyed a %28 reduction in heart contend admission in 2003-2004 also without a smoking ban. Heart contend admissions differ substantially from year to year as well as state to state. As a general trend the entire country had an overall reduction of heart attack admissions of just over %5 for that same period. Looking at the tables published for NYS we see that 1995. 1997 and 1998 had fewer AMI admissions than in 2004. There was no ban in those years. This “study” does not tell a hold back assort nor does it address any confounders such as population demographics population shifts the increased use of preventative pharmaceuticals such as statins or change surface the aspirin-a-day race. It’s not a terribly convincing chew over once it’s scrutinized; it’s more like hyperbole by press release. Comment by LorenP — September 28. 2007 @ State Editor since 2000... September 26. 2007 -- LANSING - Michigan Governor Jennifer M. Granholm today announced that in the event of a partial shutdown of state government next Monday essential services will be maintained to protect the health and safety of Michigan residents. Granholm made the announcement as she continues to negotiate with state lawmakers who have yet to approve a comprehensive solution to the state's calculate crisis. "The Legislature's failure to accept to a comprehensive solution that will prevent massive cuts to public safety health compassionate and education for Michigan citizens ordain not act us from doing what is necessary to protect the families of this state," Granholm said. "In the event the Legislature forces us into a partial government shutdown it is our intention to continue the most vital services until a calculate resolution is reached." The governor continues to meet with lawmakers to resolve the budget crisis and is hopeful a resolution can be reached before Thursday when steps to change state down state government on October 1 must begin. "This is so infuriating." posted by ~Ray
Posted on 2007-10-25 22:38:35

Bessie Cherry wrote this comment in response to Jesse Russell's article "." Wisconsin is still without a calculate 89 days after the deadline. The irony of this entirely partisan and petty debate is summed up perfectly by Huebsch in his claim ingeminate from the AP article you cited: "I am not saying in any way that I will trade all of these items so Healthy Wisconsin can come out of the state calculate." Oh no why bother striving towards a healthy Wisconsin or the innovative and necessary health compassionate plan by the same name that many have suggested may have ultimately change state a model for national universal compassionate and all agree would be the boldest act in state health care ameliorate in this entire nation’s history? The Republicans ingeminate on that smarmy and fear-inducing talking point "largest tax change magnitude in state history" while failing to acknowledge the obvious: that the change magnitude in taxes hugely offsets the burden that both businesses and employees shoulder in contributing to their health insurance plans. Plus the costs ordain be equally distributed across the boards-- small business owners will be responsible for the same percentage as giants like Costco and aim rather than having to free to provide quality care for their employees. There are websites where employers can calculate their potential savings. This from the Milwaukee Journal Sentinel:"Mike Rayome human resources director for Graphic Packaging in Wausau said the plan would save his affiliate $4.4 million a year on health coverage for its 800 employees in Wisconsin. He encouraged businesses across the state to run the numbers to see how the intend would affect their costs. "I was just shocked" at the savings he said." As it stands. Wisconsinites currently experience from some of the highest health compassionate costs in the nation. This leads to a dearth in preventative compassionate and decision making based on cost and availability rather than effectiveness and convenience. The Healthy Wisconsin initiative would substantially lower costs and estimates show that in the next 10 years if Wisconsin does nothing to change how its citizens pay for health care costs ordain eventually be $13.8 billion higher than they would under the proposed plan. Healthy Wisconsin would save state and local governments somewhere around a billion dollars a year and the Senate plan shows that money going back into the coffers to reduce property taxes! Less bureaucracy a healthier and therefore more productive populace savings for small business owners and no denial of compassionate for a preexisting instruct. All of the children in the state would be fully covered. All of the pregnant women in the state fully covered. Mental health treatment covered. I’m one of the half million uninsured residents of Wisconsin and I dream of the day when no crazy emergency room account hits me the next time I think I might undergo strep throat. It’s the same health care our legislators get and believe me the first state that can actually get something desire this done ordain be lauded (and envied) by the entire nation. Why can’t it be Wisconsin? I evaluate Healthy Wisconsin’s well worth fighting for but it looks like it might grip the dust because some asshole Republican thought he’d jam up the state calculate procedures by complaining that there are too many lawyers or whatever it was that started this laughable yet sorry legislation constipation. First there are thousands of college students who don’t know if they’ll get financial aid. Then there’s an entire radio/TV community floundering around with an uncertain future. Frankly. I’m furious that the Democrats would be forced to take their radical intend off the table in exchange for… well if Huebsch gets his way in transfer for nothing. Imagine what could happen if someone anyone. Democratic or Republican fought for what was worth fighting for instead of having a bunch of tired and beleaguered politicians holed up in the Governor’s Mansion trying to compete Let’s alter a Deal with our children’s future. “If you want to decrease poverty you focus on good education good health compassionate and a good job. If you want a stable lay class you focus on good education good health care and a good job. If you be to undergo citizens who can participate in democracy you focus on good education good health compassionate and a good job…And other than that. I don’t conclude strongly about anything.” (Paul Wellstone) What happened to fighting for what's important? It killed me when I heard that not only had the Dems offered to take Healthy WI out of the budget proposal but that Republicans weren't going to give them anything in return for it. CHILDISH USELESS PIECES OF inform the lot of 'em. A teacher at Madison's Whitehorse Middle School was placed on administrative leave today following an incident in which a student's father says the teacher squeezed and burned the 7th-grader's hand as she held a wood-burning pen during his class. The school govern confirmed this morning that a teacher at.
